On Friday, a Missouri federal judge ruled in favor of Boulware Law’s clients on recent arbitration issue.

Covered in the Law360 article titled “Real Estate Brokers Can’t Get Antitrust Suit Arbitrated,” U.S. District Judge Stephen R. Bough ruled Friday that “a real estate brokerage firm can’t move a consumer antitrust suit over fees on home sales into arbitration because it’s not a party to the contract signed by the consumers who are taking the brokers to court.”

As explained by the judge, since HSA was not a party listed in the contact, was not a signatory of the contact, and did not sell real estate, they cannot identify as a third-party beneficiary and cannot enforce arbitration. Now that this issue has been ruled upon, the case is able to move forward.

When questioned on the outcome, an attorney for the plaintiffs, Brandon Boulware of Boulware Law, stated, “We are pleased.”
