A Kansas federal judge ruled in favor of Boulware Law’s on a Motion to Dismiss filed by Defendants in an overtime and minimum wage dispute with a well-known restaurant chain.
Covered in the Law360 article titled “Mexican-American Restaurant OT Suit is Allowed Proceed,” U.S. District Court Judge Toby Crouse determined that the server’s claims against the restaurant were substantial enough to allow the proposed class and collective action to move forward.
The judge rejected Defendants’ arguments in their Motion to Dismiss, and held that “Assuming her allegations are true, Florece has shown defendant’s’ conduct — a failure to pay — caused her injury and can be remedied in this litigation.”
