A Judge in Jackson County, Missouri sided with Boulware Law’s client, Hy-Vee Inc., in finding that the City of Lee’s Summit erred by putting it in a special taxing district as a public funding source for a mixed-use project.
The Court found that Defendants violated Hy-Vee’s due process and equal protection rights under the Missouri Constitution, and also exceeded their authority under the state’s CID Act by drawing a non-contiguous district. The Court further found a violation of Hy-Vee’s equal protection rights because Defendants gave no rational basis for including the store in the CID while excluding many similar businesses surrounding the store.
